TERMS & CONDITIONS
TERMS & CONDITIONS
The following terms and conditions apply to all items ordered from the Target Darts website.
Please read through the following information carefully before placing your order. By using this website and/or placing an order you agree to the terms and conditions set out below. Please also read our Privacy Policy regarding personal information provided by you.
We may change these terms and conditions from time to time, and these changes will apply to any subsequent orders received. Once your order has been confirmed, we will not be able to make any changes to the terms that apply to that order.
If you have any queries relating to these terms and conditions, please contact us.
1. About us and these Terms
These Terms and Conditions (“Terms”) apply when you buy products through the Target Darts global website (the “Website”). The Website is operated by Target Sports Ltd (“Target”, “we”, “us” or “our”), a company registered in England and Wales. Our customer service and returns contact details are set out on the Website and in the Global Delivery & Returns Policy.
By placing an order, you agree to these Terms. Please read them before ordering. Nothing in these Terms limits any consumer right or remedy that cannot lawfully be excluded or restricted.
2. Where we sell
We sell and deliver only to the countries, territories and addresses made available at checkout. Product availability, pricing, currency, payment methods, delivery services, promotions and returns arrangements may vary by destination.
We may change the destinations we support at any time. We may decline an order where we cannot lawfully or operationally supply the product to the selected destination.
3. Your order
You are responsible for checking your basket, delivery address, contact information, selected delivery service and all charges before submitting your order. By ordering, you confirm that the information you provide is accurate, that you are legally capable of entering into the contract and that you are authorised to use the selected payment method.
After you submit an order, we will send an electronic acknowledgement.
We may refuse or cancel an order before acceptance where a product is unavailable, there is an obvious pricing or description error, payment cannot be authorised, fraud or misuse is reasonably suspected, a product cannot be supplied to the destination, or another legitimate reason prevents fulfilment. If we cancel after taking payment, we will refund the relevant amount.
4. Products
We take reasonable care to describe products accurately. Images are illustrative and colours, finishes, packaging and minor product details may vary. All products are subject to availability.
Customers are responsible for using products in accordance with supplied instructions and warnings. Nothing in this clause affects rights relating to faulty, unsafe, misdescribed or non-conforming goods.
5. Prices, currency and charges
Prices are shown in the currency selected or made available for the destination. Before an order is placed, checkout will show the product price and applicable delivery charges and will explain whether import duties and taxes are included or may be payable separately.
Your bank, card issuer or payment provider may apply exchange-rate adjustments or international transaction fees. Those charges are not imposed by Target.
We may change prices prospectively. If an obvious pricing error occurs, we may reject or cancel the affected order and refund amounts already paid, subject to applicable law.
6. DDP orders - duties and taxes paid
Where checkout identifies an order as “DDP”, “duties and taxes included”, the applicable import duties and import taxes will be calculated and collected from you at checkout as part of your order. Target, or our appointed service provider, will then arrange payment of those amounts to the relevant customs authorities as part of the import process.
The checkout will state whether those amounts are included in the displayed product price or added separately. Except for charges arising from inaccurate customer information or where required by applicable law, you should not normally be asked to pay the same import duties or taxes again on delivery.
7. DAP / duties and taxes unpaid orders
Where checkout identifies an order as “DAP”, “duties and taxes unpaid”, the amount paid to Target does not include destination-country import duties, import VAT/GST/sales tax, customs charges, brokerage fees or similar import charges unless checkout expressly says otherwise.
The recipient may be required to pay such charges to a carrier, broker or government authority before or after delivery. The customer is responsible for those charges to the extent permitted by applicable law.
If the recipient refuses or fails to pay required import charges and the shipment is returned, we may deduct reasonable costs actually incurred as a result - including return carriage, customs or carrier charges - from any refund, where permitted by applicable law.
8. Customs and import information
International shipments may be subject to customs clearance. You must provide accurate information reasonably required for export, import and delivery. A carrier or authority may require additional recipient information, including identification or tax information.
Customers must not order products that they are prohibited from importing, possessing or using in their destination. Target will also take reasonable steps required of it as seller under applicable law. Customs processing may cause delays outside our reasonable control.
9. Payment
Available payment methods are shown at checkout. Payment will be processed by Target or an authorised payment provider. We may carry out payment verification and fraud-prevention checks.
10. Delivery
Delivery options, charges and estimated timeframes are shown at checkout and/or in the Global Delivery & Returns Policy. Unless expressly stated otherwise, delivery dates are estimates rather than guarantees.
International delivery may be affected by customs, carrier disruption, public holidays, severe weather, peak trading periods, product launches or other events outside our reasonable control. We will comply with any mandatory delivery deadlines and remedies applicable to the customer.
11. Failed delivery and address errors
You must provide a complete and accurate delivery address and contact details. We may be unable to amend an address after fulfilment begins.
Where delivery fails because of an incorrect or incomplete address, non-collection, recipient unavailability, or failure to provide required information, we may charge or deduct reasonable additional delivery or return costs to the extent permitted by law.
12. Cancellation, returns and refunds
Cancellation, withdrawal, returns and refund rights are described in the Global Delivery & Returns Policy. That policy forms part of these Terms.
Nothing in our discretionary returns policy limits statutory rights relating to cancellation/withdrawal, faulty goods, damaged goods, misdescription or other non-conformity.
13. Warranties
Some Target products may include a separate commercial or manufacturer's warranty. Any such warranty is additional to mandatory statutory rights and does not replace them. Product-specific warranty terms apply.
14. Promotions
Promotions, discount codes, bundles and special offers may have separate terms and may be limited by country, product, currency, customer type or period. If a promotional order is partly returned, the refund may be recalculated to reflect the promotion originally applied, where lawful.
15. Our liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including any liability or consumer remedy that cannot legally be excluded.
Subject to applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was made or for business losses arising from a consumer purchase. Any country-specific limitation language must be approved by Legal before launch.
16. Events outside our reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, subject always to mandatory consumer rights. These may include transport disruption, customs delays, severe weather, natural disasters, industrial action, governmental action, telecommunications failures, war, civil disturbance, epidemics or pandemics.
17. Privacy
We process personal information in accordance with our Privacy Policy. International fulfilment may require us to share relevant information with payment providers, carriers, customs brokers, tax providers and government/customs authorities where necessary to process, clear and deliver an order.
18. Changes and contact
We may update these Terms from time to time. The version applicable to an order will normally be the version in force when that order is placed.
Questions about orders, delivery, returns or these Terms should be directed to Target Customer Care using the contact details published on the Website.
